Heard learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondents.
The petitioner has preferred the present writ petition inter-alia with the prayer to issue a mandamus to respondents no.2 and 3 to regularize the petitioner at his respective post of Gardner in the District Horticulture Department (Zila Uddhyan Vibhag) Budaun from its due date as well as to pay regular pay scale/salary admissible to his post immediately within some specific time.
It is argued by learned counsel for the petitioner that petitioner was appointed on the post of Gardner in the year 1995. He argued that since he is working regularly, he is entitled for consideration of his case for regularization in view of Government Order dated 13.08.2015. It is further argued that though representations were made by the petitioner from time to time but till date no decision has been taken on the same.
It is argued by learned Standing Counsel that concerned competent authority will take a decision in the matter soon.
Heard learned counsel for the parties.
With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
In the facts and circumstances, the petitioner is permitted to make a fresh representation ventilating all his grievances before the respondent no.3 along-with certified copy of this order within a period of three weeks from today. If such a representation is made, the respondent no.3 is directed to pass appropriate order in accordance with law within a further period of three months.
With the aforesaid observations, present writ petition is disposed of finally.
It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
