Heard S. Chandra, learned counsel for the applicant and Sri Amit Sinha, learned AGA for the State and perused the material on record.
This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant seeking enlargement on bail during trial in connection with Crime No. 211 of 2016, under Sections 498A, 304B of IPC & Section 3/4 of Dowry Prohibition Act, P.S. Ghoorpur, District Allahabad.
Learned counsel for the applicant submits that he is not pressing this application on merits and purpose of filing this application would be served if direction is issued to the trial court to conclude the trial within stipulated period.
State counsel has no objection to this proposition. He, however, submits that two witnesses have already been examined.
The present bail application is dismissed as withdrawn.
However, considering the detention period of the applicant, trial court is directed to conclude the trial as expeditiously as possible and preferably within six months from the next date of recording the evidence.
It would be the duty of the applicant to apprise the court below about the passing of this order by producing a certified copy of the same before it.
