(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for leave to prefer appeal against the judgment and order passed by the learned Sessions Judge in Sessions Case No.139 of 2010, whereby, the accused has been acquitted for the offence under Sections 302, 307, 34 of Indian Penal Code read with Section 135 of Bombay Police Act.

Considering the facts and circumstances, leave deserves to be granted. Therefore, granted. Application disposed of accordingly.
