JUDGMENT / ORDER

Heard the submissions of Mr.S.Ramasamy, learned counsel appearing for the petitioner and Mrs.R.Anitha, learned Additional Government Pleader appearing for the first respondent and Mr.D.Murugananthan, learned counsel appearing for the second respondent.
2. The petitioner got later entry admission for B.E. Degree course in the second respondent college on 03.07.2008. The petitioner at the time of joining the second respondent college, paid the tuition fees of Rs.32,500/-, bus fees of Rs.10,800/-, store fees of Rs.6,000/- and Aut-Sports and registration fee of Rs.1,050/- in all aggregating a sum of Rs.50,350/-. The second respondent has also issued a receipt, vide in No.432.

The petitioner within month of joining the second respondent college and selected B.E., Degree course in Anna University, Coimbatore and he was also joined the said course in the month of September 2008. The petitioner submitted a representation, dated 26.08.2008, to the first respondent seeking refund of his fees paid to the second respondent and the first respondent vide letter No.5088/J2 dated 26.08.2008, has directed the second respondent herein to refund the fees paid at the time of admission and refund the same to his office.
4. The grievance of the petitioner is that in spite of the order passed by the first respondent, the second respondent has not chosen to refund the fees in this regard. The petitioner has submitted representation, dated 19.12.2008, to the second respondent by RPAD, the second respondent in spite of receipt of the said representation, has not chosen to refund the fees and hence, this Writ Petition.

This Court taking into consideration, the rival submissions and on a perusal, the letter dated 26.08.2008, sent by the first respondent to the second respondent, directs the second respondent to dispose of the petitioner's representation, dated 19.12.2008, in the light of letter No.5088/J2/2008 dated 26.08.2008, sent by the first respondent to them, within a period of two weeks from the date of receipt of a copy of this order.
6. The Writ Petition is ordered accordingly. No costs.
