Whether the Courts below were justified in holding that the question of following the provisions of the Gujarat Public Premises (Eviction of Unauthorized Occupants) Act, 1972 does not arise in the matter?

Whether the lower appellate court was justified in holding that upon the death of defendant No.1, the irrevocable Power of Attorney executed by him in favour of the plaintiff became inoperative and unenforceable?
