JUDGMENT / ORDER

Heard Mr.Premal Rachh, learned counsel for the applicant, Mr.H.L. Jani, learned Additional Public Prosecutor for respondent No.1 and Mr.Rajeshkumar Venishankar Joshi, Party-in-Person respondent No.2.
Mr.Rachh states that pursuant to order dated 15th March, 2012 passed by this Court the applicant has surrendered himself on 15th March, 2012 and at present the applicant is in jail. He has further stated that the applicant is ready to deposit Rs.60,000/- as ordered by the learned Chief Judicial Magistrate, Amreli. Mr.Rachh has also stated that today son of the applicant is present before the Court with the amount. Mr.Rachh has also produced application Exhibit 66 and order passed below the said application. He, therefore, contended that looking to the situation, present applicant may kindly be released on bail pending the revision application.
Heard Mr.Rajeshkumar Venishankar Joshi, Party-in-Person respondent No.2-original complainant.
He states that first the applicant may be directed to deposit the amount as ordered, i.e. Rs.60,000/-, with the concerned Court and then only the applicant may be released on bail. Mr.Joshi further states that he has no objection if the applicant be released on bail on depositing Rs.60,000/-. Mr.Joshi also states that he may be permitted to withdraw the said amount so deposited by the applicant.
Heard Mr.Rachh, learned counsel for the applicant and Mr.Rajeshkumar Venishankar Joshi, original complainant. I have also perused the application Exhibit 66 and order passed below the application. The same is ordered to be taken on record. The applicant is directed to deposit Rs.60,000/- with the learned In-charge Chief Judicial Magistrate, Amreli. The learned In-charge Chief Judicial Magistrate, Amreli is directed to accept the amount so deposited by the applicant. Mr.Rajeshkumar Venishankar Joshi is permitted to withdraw the said amount deposited by the applicant. The learned In-charge Chief Judicial Magistrate, Amreli is also directed to release the applicant on bail on his furnishing receipt showing deposition of Rs.60,000/- on usual terms and conditions.
The matter is adjourned to 28th March, 2012.
Direct Service is permitted, today.
