The petitioner who is an association of the clay potters claimed that the land reserved for clay potters has been subjected to encroachment by unauthorized persons and in this regard they have filed application before the concerned Sub Divisional Magistrate and District Magistrate by registered post on 07th January, 2019 but no action has been taken till date in the matter.
In the facts and circumstances of the case, the petitioner is permitted to make fresh application before Sub Divisional Magistrate concerned, who on receiving such application shall look into the grievance of the petitioner and shall pass appropriate orders thereon within period of three months from the date of production of certified copy of this order. It is further made clear that in case if persons are found to have encroached upon the land, strict action shall be taken against them but only in compliance of the principles of natural justice and authorities shall also carry out necessary measurement exercise on the spot with reference to the relevant revenue records and after putting notice to all concerned.
With the aforesaid observations and direction, the writ petition is disposed of.
