Heard learned counsel for the petitioner, learned Standing Counsel and Sri F.A. Ansari appearing for the respondents.
A communication dated 10th December, 2018 is challenged on the ground that post against which respondent no.6 is proposed to be promoted is meant to be filled by direct recruitment, and that promotional exercise undertaken is unwarranted and contrary to law.
Admittedly promotion from the post of Assistant Teacher in L.T. Grade to Lecturer's Grade has to be made in accordance with the provisions contained in Section 12 of the U.P. Secondary Education Services Selection Board Act, 1982 as well as Rule 14 of the U.P. Secondary Education Service Selection Board Rules, 1998. It is the promotional committee, which has to examine all issues including existence of post, qualification and candidature of all eligible persons. At this stage, no occasion arises for the petitioner to approach this Court, inasmuch as the competent authority is yet to examine all such issues.
Leaving it open for the petitioner to represent her grievance, at the appropriate stage, before the competent authority, this writ petition is consigned to records.
