JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) This is an application by the appellant-wife for stay of execution of the impugned decree for divorce granted by the learned Family Court.
After hearing the learned counsel for the parties, we dispose of this application by restraining the respondent-husband from contracting any further marriage during the pendency of the appeal.
Let the hearing of the appeal be expedited.
As proposed by the learned advocate for the respondent, let six sets of informal paper book be prepared by the respondent. The paper book should include petition for divorce, written statement, all evidence - oral and documentary, the judgment and decree impugned and the memorandum of appeal presented before this Court - with translations of all the documents which are in vernacular language. Such paper book is to be filed within four weeks from the date of service of arrival of record and proceedings from the trial court.
Since the learned advocate for the respondent is to prepare the paper book, office shall serve notice on arrival of the record and proceedings not upon the learned advocate for the appellant but on learned advocate for the respondent.
As soon as the paper book is supplied, the appeal be treated as ready for hearing and listed before the appropriate court for hearing.
The Civil Application is accordingly disposed of.
