Heard Sri Pradeep Chauhan, learned counsel for the petitioner. Learned Standing Counsel has appeared for respondents no.1 & 2.
It is peculiar kind of petition which has been filed by the petitioner which is virtually for protection of the personal liberty of the petitioner from the private respondents no.3 to 7 who are none other than her family members.
The petitioner claims that she is a major and a student of 3rd year diploma course in computer engineering of the Polytechnic Institute, Vishveshwarya Group of Institutions Greater Noida, Gautam Budh Nagar. Her family members are trying to marry her against her wishes to an elderly person whose first wife has died. The petitioner is not in favour of such a marriage and she wants to complete her education. In these circumstances, she has no option but to seek protection from the Court for her life and personal liberty.
The aforesaid problem as raised by the petitioner is not a legal problem but a social one which cannot be resolved or adjudicated by the Court rather a solution of the same has to be found by the society itself. However, as the petitioner has submitted a representation in this regard to the S.S.P., Gautam Budh Nagar we dispose of the writ petition with the expectation that the S.S.P., Gatum Budh Nagar would consider the above application of the petitioner and get the facts verified so as to ensure that the petitioner is not forcibly married against her wishes and she completes her education.
The writ petition is disposed of with the observations as above.
