Petitioners have approached this court for a direction upon the respondents to release arrears of honorarium payable to petitioner Nos. 1,2 and 9, working on the post of Guest Subject Expert in different government aided Intermediate College in District Bareilly for the period September, 2013 to March, 2018. In respect of other petitioners the amount is claimed for the month of September 2013 to March 2018. It is stated that application in that regard has already been forwarded by the District Inspector of Schools, Bareilly to the Director of Education, but thereafter no action has been taken and the amount due and payable has not been released to petitioners. It is stated that the rights of petitioners to receive such amount has already been settled by the State Government and funds have also been sanctioned on 6.7.2016. As the authorities have not examined petitioner's candidature in that regard, petitioners are before this Court. It is also stated that the petitioners are entitled to honorarium for 10 months as per Government Order but they are only being paid honorarium for the period of 9 months.
Learned Standing Counsel submits that such issues of fact can be examined by the Director concerned, at the first instance.
In the facts and circumstances, noticed above, writ petition stands disposed of, permitting the petitioner to represent in the matter before the respondent no. 2, alongwith certified copy of this order, within a period of four weeks from today. The petitioners shall be at liberty to annex all materials in support of their claim. The Director may call for appropriate reports from the institution concerned and thereafter proceed to pass an appropriate order, in accordance with law, within a further period of four months thereafter.
