Heard learned counsel for the petitioner.
Present writ petition has been filed for setting aside of the order dated 15.12.2017 passed by the Principal Judge, Family Court, Agra, respondent no. 1 in Suit No. 1842 of 2015, Deepak Bharadwaj Vs. Rashmi Sharma whereby the application under Order 6 Rule 17 CPC for amendment in the plaint has been allowed.
I have heard learned counsel for the petitioner on merits.
Without interfering in the order impugned herein at this stage present writ petition stands disposed of with liberty to the petitioner to challenge the order while challenging the final judgment if the need so arise.
However, it would be in the interest of the parties that the suit itself may be decided expeditiously.
Section 21-B of the Hindu Marriage Act, 1955 specifically provides that all proceedings under the Act should be held on a day to day basis and effort should be made to conclude the proceedings as far as possible within six months from the date of service of the petition on the respondent.
In view of the aforesaid provisions under the Act, I am of the opinion that no further direction is required and the petitioner is at liberty to move appropriate application for this purpose.
The petition is accordingly disposed of.
