High Court Of Judicature at Allahabad|30 July, 2019

JUDGMENT / ORDER

Heard Sri Agendra Sinha, learned counsel for the petitioners.
Notices for opposite parties have been accepted by the office of learned Chief Standing Counsel.
The submission of learned counsel for the petitioners is that they are aggrieved from so many technical difficulties which the petitioners faced on 11.7.2019 when the Computer Typing Test was conducted. On the said date the server connection was not proper, the software was not functioning properly and the highlighters were not properly functioning and so on. The petitioners have preferred a representation dated 15.7.2019 to the Chairman, U.P. Police Selection and Promotion Board but no proper decision has been taken.
The submission of learned counsel for the petitioners is that the petitioners are not seeking any favour or any unwarranted order but they are only seeking the relief to the extent that at least the problems so faced by the petitioners at the time of Computer Typing Test which held on 11.7.2019, should be sorted out inasmuch as the petitioners have not been declared qualified for the reason they were not responsible. As per learned counsel for the petitioner had the problems so cropped up at the time of Computer Typing Test had been addressed properly the petitioners would have been declared successful. He has further submitted that the problems were beyond the control of the petitioners and if the concerning authorities had taken care of the problems of the petitioners, the examination in question would have been conducted properly.
Since the petitioners have already preferred representation to the competent authority, therefore, it would be expedient in the interest of justice and the petitioners that all the petitioners should prefer their separate representations to the Chairman, U.P. Police Selection and Promotion Board, Lucknow ventilating their grievance separately taking all pleas and grounds which are available to them enclosing therewith the copies of documents which are necessary for the disposal of the representations within a period of 7 days from today and if such representation is preferred by the petitioner to the aforesaid competent authority within aforesaid stipulated time, the grievance of the petitioners would be considered properly and any appropriate orders would be passed with expedition preferably within a period of two weeks thereafter and the decision thereof shall be communicated to the petitioner. While disposing the representation of the petitioners the competent authority may provide the opportunity of personal hearing to the petitioners so as to understand the grievance of the petitioner properly.
It is expected that the competent authority shall pass speaking and reasoned order.
With the above directions, writ petition is disposed of finally.
