Heard learned counsel for the applicant, Sri Rajeev Chowdhary, learned counsel for the informant and learned A.G.A. for the State respondent.
This is second bail application moved on behalf of the applicant for enlarging her on bail in case crime no. 413 of 2014 under Section 419, 420, 467, 468, 471, 504, 506, 406 IPC, P.S. Cantt. District Gorakhpur.
It is contended by the learned counsel for the applicant that the applicant is old aged lady suffering from old aged ailments. It is further contended that there is nothing on record to show complicity of the applicant in the alleged offence and she has been falsely implicated. It is also contended that charge sheet was submitted on 4.3.2015 but trial of the case has not been proceeded and the matter is not likely to be concluded near future. The applicant is in jail since 11.12.2014.
Learned counsel for the informant has stated that the applicant is the main accused and the co-accused, who was granted bail, is absconding, therefore, trial is not proceedings.
After hearing the learned counsel for the parties and after perusing the materials on record, this Court is of the opinion that no good ground is made out for enlarging the applicant on bail. The prayer for bail is rejected.
However, the present bail application is disposed of with the direction to the court concerned to conclude the trial of aforesaid case, expeditiously, preferably within a period of eight months from the date of production of certified copy of this order before it, in accordance with law, without granting unnecessary adjournment to either of the parties, if proceedings is not stayed by any court of law.
