Heard learned counsel for the applicant, Shri Sanjay Srivastava, learned counsel for the complainant and learned Additional Government Advocate.
It is argued by the learned counsel for the applicant that the applicant is the Jeth. The deceased died a natural death and the report of the Chemical Examiner shows that no poison was found in viscera. The case of the applicant is distinguishable from that of the husband.
Learned counsel for the complainant argued that the deceased died within two months of the marriage and the dead body was hurriedly cremated without any information to the complainant.
Having considered the submissions of the parties and without expressing any opinion on the merits of the case, let the applicant- Rashid alias Mohammad Yunus, involved in case crime No. 767 of 2008, under sections 304-B/201 IPC, PS Seohara, district Bijnor, be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned with the conditions:
1. That the applicant will not tamper with the evidence.
2. That the applicant shall report to the CJM concerned in the first week of every month to show his good conduct and behaviours.
3. That the applicant will cooperate with the trial.
In case of any default by the applicant, the bail granted to him shall stand cancelled.
