Heard Sri Dinesh Kumar Pandey, learned counsel for the petitioner and Sri Sanjay Kumar Srivastava, learned counsel for the respondent nos.1 and 2.
By means of this writ petition, the petitioner has prayed for mandamus commanding the respondents not to recover the disputed amount of Rs.11,72,355/- from the petitioner. Further prayer is made for a direction upon the respondent nos.3 and 4 to return the Truck No.UP 92 T-4403 to the petitioner within specified period.
The petitioner is seeking relief against the private company i.e. respondent nos.3 to 4, which is not a State within the meaning of Article 12 of the Constitution of India.
The present writ petition on the face of it, is not maintainable. The writ petition is, accordingly, dismissed.
