Heard Sri Udayan Nandan, learned counsel for the petitioner, Sri Amit Raj Chaurasiya, learned A.G.A. for the State, perused the impugned F.I.R. as well as material brought on record.
Sri Vinay Dubey and Sri Vishnu Kumar Yadav, learned counsels for the caveator are not present though the matter is called in revised list.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 29.07.2018 registered as case crime no.0366 of 2018 under sections 420, 467, 468, 471, 504, 507 I.P.C., Police station Kareily, District Allahabad.
Learned counsel for the petitioner submits that some cheques were issued by respondent no.4 in favour of the petitioner but the same were dishonoured and complaint u/s. 138 N.I. Act was filed by the petitioner against respondent no.4, hence, the present FIR and civil litigation is also pending between the parties.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
