Petitioners are street vendors within the area of Thrissur Corporation (for short, the “Corporation”). They have approached this Court aggrieved by the proposed action of the Corporation to evict them from Mulayam Road Junction within the area of the Corporation. The petitioners submit that they are entitled for licence in terms of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 (for short the “Street Vendors Act”). The Corporation appears to have formulated a scheme to rehabilitate and accommodate street vendors.
Therefore, the Corporation shall consider the claim of the petitioners for licence in terms of the Street Vendors Act. This Act, in fact, has replaced National Policy on Urban Street Vendors. The petitioners shall raise their claim before the Corporation in W.P.(C) No.12937 of 2014 2 terms of the above Act, within three weeks from the date of receipt of a copy of this judgment. The Corporation shall consider the request of the petitioner within a further period of two months. Till a decision is taken by the Corporation, no action shall be initiated against the petitioner to evict them from occupation of Mulayam Road Junction.
The writ petition is disposed of as above.
