This application u/s 482 Cr.P.C. has been filed on behalf of applicant seeking the quashing of impugned charge sheet dated 25.7.2019 as well as cognizance order dated 2.2.2019 and entire criminal proceedings in Case No.8 of 2019 (State vs. Ras Bihari Singh), arising out of Case Crime No.176 of 2017, u/s 279, 304-A I.P.C., P.S.-Ahraura, District-Mirzapur, pending in the court of Additional Chief Judicial Magistrate, Mirzapur.
Heard Shri Sudhakar Pandey, Advocate holding brief of learned counsel for the applicant and learned A.G.A. and also perused the record.
The legitimacy of the submission of charge sheet has been challenged by way of this application but the relevant material collected through investigation has not been annexed along this this application. There is no way to adjudicate upon the validity of the charge sheet in such circumstances. The application stands dismissed for reasons of latches.
