R.Arockiasamy vs Dharmaraj

Madras High Court|04 October, 2017

JUDGMENT / ORDER

This petition is filed for punishing the respondents for their willful disobedience of the order passed by this Court in W.P.(MD)No.4182 of 2017, dated 13.03.2017.
2.In the Writ Petition filed by the petitioner in W.P.(MD)No.4182 of 2017, this Court, by order dated 13.03.2017 disposed of the Writ Petition with a direction to the respondents 2 and 3 to consider the representation of the petitioner dated 08.02.2017 and to pass appropriate orders on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of the order.
3.The learned counsel appearing for the first respondent submitted that the order of this Court has been complied with by paying the difference amount in salary arrears as well as gratuity arrears. The learned counsel appearing for the first respondent produced a copy of the proceedings of the Assistant Manager (Legal) of the Corporation, dated 12.09.2017. However, the second respondent has also by proceedings dated 23.09.2017 informed the petitioner that the arrears due to the difference between the amount disbursed and the amount the petitioner is entitled to as per the settlement will be paid in future, as sufficient funds are not available with them. It is stated that the representation of the petitioner will be considered after getting financial support from the Government. Since this Court has only directed the respondent to consider the petitioner's representation, the proceedings referred to above issued by the respondents 1 and 2 shows that the respondents have complied with the direction of this Court and that there is no wilful disobedience or violation of the order passed by this Court. Hence, this Contempt Petition is closed. However, liberty is given to the petitioner to challenge the order passed by the second respondent, in the manner known to law. No costs.
