R.Arivalagan vs The District Collector

Madras High Court|07 August, 2017

JUDGMENT / ORDER

(Order of the Court was made by G.R.SWAMINATHAN, J.) The writ petitioner seeks removal of the temporary road constructed from Natham Village to Alampadi Mettu Theru.
2.According to the writ petitioner, the said road was constructed for the purpose of enabling transportation of the sand. Now the mining operation has been closed. Therefore, there is no need for the said gravel road to continue to remain. The existence of the said road only facilitates illegal sand mining. The writ petitioner therefore gave a representation dated 21.04.2017 to the respondents. In the said representation, the writ petitioner has alleged that illegal sand mining continues to take place.
3.We therefore direct the respondents 1 and 4 to independently dispose of the representations dated 10.04.2017 and 21.04.2017 submitted by the writ petitioner. The respondents 1 and 4 shall dispose of the representations within a period of three months from the date of receipt of a copy of this order. The respondents are directed to communicate a copy of the orders passed by the writ petitioner.
4.The Writ Petition is accordingly disposed of . No costs.
