This contempt case was instituted alleging willful disobedience to the order dated 20.09.2012 passed by this Court in W.P.No.26655 of 2001. By the said order, this Court directed the respondents in the writ petition to provide compassionate appointment to the petitioner in a suitable post as per his eligibility.
It is now stated that under order dated 25.04.2014, the National Cadet Corps Directorate, Andhra Pradesh, appointed the petitioner as a Junior Assistant on temporary basis. The order also reads to the effect that the petitioner’s services will be regularized subject to the antecedents being found satisfactory on verification.
Sri V. Sudhakar Reddy, learned counsel, pointed out that the appointment is stated to be conditional and that action would be taken as per the orders issued by the Government of Andhra Pradesh. However, the order passed by this Court was only against the Ministry of Defence, Government of India; the Deputy Director General, National Cadet Corps Directorate, Secunderabad; the Group Commanding Officer, National Cadet Corps Group Headquarters, Visakhapatnam; and the Commanding Officer, National Cadet Corps, Visakhapatnam. The State Government was not a party to the writ petition. The role of the State Government was not in issue and cannot therefore be considered at this stage in this contempt case.
In the light of the appointment provided to the petitioner in due compliance with the order passed by this Court, this contempt case does not survive for consideration and is accordingly closed.
