Heard learned counsel for the parties.
Petitioner, a Class-IV employee, by the instant writ petition, petitioner seeks following relief:
i) issue a writ, order or direction in the nature of mandamus commanding the respondents to promote the petitioner from the post of Peon to the post of Clerk (Class III) and his name may kindly be directed to be included in the promotion list sent through letter No. 1795/Adhi.Li.-2018 dated 24.12.2018 to the respondent No. 2 within time bound period which may be fixed by this Hon'ble Court.
Learned Standing Counsel submits that the fourth respondent-Settlement Officer Consolidation, Fatehgarh at Farrukhabad, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the fourth respondent-Settlement Officer Consolidation, Fatehgarh at Farrukhabad, to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
