Heard Sri Anand Mohan Pandey, learned counsel for the applicant, learned A.G.A. for the State and Sri Shailendra Kumar Upadhyay, learned counsel for the informant.
Learned counsel for the applicant submitted that the applicant is jail since 12.07.2018 and at the time when the FIR in the present case was registered there were no criminal cases against the applicant. However subsequent to the present incident, other cases have been registered, details of which are given in the supplementary affidavit and are also duly explained. It is next submitted that the injuries were reported to be simple in nature, as per the supplementary report dated 25.07.2018. On such submissions prayer for bail has been made.
On the other hand Sri Shailendra Kumar Upadhyay, learned counsel for the informant submitted that within three weeks of the incident of the present case, the applicant along with others murdered the Pairokar of the case, from the side of the informant, in respect of which FIR has been registered as Case Crime No.212 of 2018, details of which are given in the supplementary affidavit. Learned counsel for the informant further submitted that considering the conduct of the applicant he does not deserve bail.
In reply Sri Pandey learned counsel for the applicant submitted that the bail application of the applicant in the Case Crime No.212 of 2018 would be considered on its own merits and in so far as the present bail application is concerned considering that the injuries are simple, the applicant deserves to be released on bail.
Without expressing any opinion on merits of the case, I am of the view that the applicant has made out a case for bail.
Let applicant-Ranveer Singh, be released on bail in Case Crime No.179 of 2018, under sections 307, 504, 506 IPC, Police Station Dannapur, District Mainpuri, on furnishing a personal bond and two sureties each of the like amount before the court concerned subject to following conditions:-
(i) The applicant will co-operate with the trial and remain present personally on each and every date fixed after release.
(ii) The applicant will not tamper with the prosecution evidence and will not delay the disposal of trial in any manner whatsoever.
(iii) The applicant will not indulge in any unlawful activities.
(iv) The applicant will not misuse the liberty of bail in any manner whatsoever.
The identity, status and residential proof of sureties will be verified by court concerned and in case of breach of any of the conditions mentioned above, court concerned will be at liberty to cancel the bail and send the applicant to prison.
