Heard Shri Shiv Shankar Singh, learned counsel for the petitioner and learned Standing Counsel appears for the respondent nos. 1, 2 and 3.
In view of the order that is proposed to be passed, no notice is required to be issued to respondent no. 4.
The contention of the petitioner is that she has purchased an area of 0.0020 Hectares in Khasra No. 497 Kha by means of a registered sale deed dated 16.2.2017 executed by the respondent no. 4. It is contented that a transfer report dated 5.3.2017 was prepared and issued by the Lekhpal concerned and the mutation case is pending before the Naib Tehsildar, Manda, District Allahabad which is not being decided despite passage of nearly one and half years. It is contended that the respondent no. 3 is statutorily bound to decide the mutation application. Learned counsel for the petitioner has also referred to the order-sheet of the court below that has been enclosed as Annexure No. 3 to the writ petition.
Learned Standing Counsel states that the case shall be decided by the Naib Tehsildar within a period of three months.
In view of the facts and circumstances, this Court directs the respondent no. 3- Naib Tehsildar, Manda, District Allahabad to decide the mutation application of the petitioner expeditiously and preferably within a period of three months from the date a certified copy of this order is produced before him after providing an opportunity of hearing to the parties concerned provided there is no legal impediment.
With the aforesaid observation, this writ petition is disposed of.
