Ms.Pathak, learned AGP appears and waives service of rule for respondent - State.
The instant application is filed seeking temporary bail for 30 days as wife of detenu is suffering from acute appendicitis and as per the medical certificate, she requires surgery.
Having considered the submissions advanced by Mr.Prajapati, learned advocate for the applicant, so also by Ms.Pathak, learned AGP for the respondent - State, this Court is of the opinion that the application deserves to be partly allowed.
The application is partly allowed and the applicant - detenu - Ranjitsinh @ Raja Darbar S/o.Balwantsinh Dabhi is ordered to be released on temporary bail for a period of one week from the date of his actual release on his executing personal bond of Rs.10000/- (Rupees Ten Thousand only) with one surety of like amount to the satisfaction of the concerned jail authority, on the condition that during the period of his temporary bail, he shall maintain law and order and shall not misuse his liberty, and on the expiry of the period of temporary bail, he shall immediately surrender to the concerned jail authority.
The instant application stands disposed of accordingly. Rule is made absolute to the aforesaid extent. Direct service permitted.
