By this application, the applicant seeks vacation of interim relief granted by this Court vide order dated 15.10.2010 passed in Criminal Miscellaneous Application No.10803 of 2010, or in the alternative, seeks fixation of an early date of hearing of Criminal Miscellaneous Application No.10803 of 2010.
Heard Ms. Maria Dalal, learned advocate for the applicant, Mr. Devang Bhatt, learned advocate for the contesting respondents and Mr. K. P. Raval, learned Additional Public Prosecutor for the respondent No.1.
A perusal of the order dated 15.10.2010 shows that interim relief was directed to continue after issuance of rule, that is, after service of notice to the second respondent, that is, the applicant herein. Under the circumstances, no case is made out for vacating the interim relief granted vide order dated 15.10.2010. However, having regard to the averments made in the memorandum of application, the second relief can be granted.
Under the circumstances, the application is allowed. Criminal Miscellaneous Application No.10803 of 2010 to be listed for final hearing in the week commencing from 18th June, 2012. The application stands disposed of accordingly.
