1.0 Present application is filed by the daughter of the Under Trial Prisoner, who is in jail in connection with C.R. No. I-161/2009 registered with the Kagdapith Police Station for the alleged offences punishable under Sections 304, 328 and and 114 of Indian Penal Code. He is in jail since 31st July 2009. He was released on Temporary Bail by this Court by order dated 30th December 2010.
Thereafter, he was released on Temporary Bail by 20th September 2011.
2.0 Rule.
Learned Additional Public Prosecutor Mr. Patel waives service of process of Rule.
3.0 Taking into consideration the contents of the application, the application is allowed. The Under Trial Prisoner is ordered to be released on Temporary Bail for a period of 30 days on the same terms and conditions on which he was earlier released.
3.1 In addition to above, the Under Trial Prisoner is directed to mark his presence at the nearest Police Station between 9:00 a.m. to 2:00 p.m. on every alternate day.
3.2 The Under Trial Prisoner shall surrender to the jail authorities on expiry of the Temporary Bail period.
3.3 Rule is made absolute to the aforesaid extent.
