In first call, learned Advocate for petitioner did not attend the hearing. Any request for passover or adjournment was also not made. However, the hearing was deferred. Even in second call, learned Advocate for petitioner is not present. Mr. Parikh, learned Advocate for respondent has attended the hearing in first call as well as in second call.

Considering the absence of petitioner and his advocate in two calls, petition is dismissed for non-prosecution.
