JUDGMENT / ORDER

Petitioner is the 2nd accused in Crime No.609 of 2014 of the Hosdurg Police station for the offences punishable under Secs.143, 147, 148, 341, 323, 324 and 308 read with Sec.149 of the Indian Penal Code, is in custody from 26.05.2014 and seeks bail. 2. Learned Public Prosecutor has opposed the application. It is submitted that on 24.05.2014 at about 7 p.m., the petitioner and others formed unlawful assembly,attacked the defacto complainant and others with iron rod, stick, stone etc. and caused hurt in their attempt to cause their death. Three persons sustained injuries. Some of the accused are to be arrested/identified.
3. Learned counsel submitted that even in the FIS there is no specific overt act attributed to the petitioner. Learned counsel has taken me through the FIS.

4. It is a case of alleged attack on the defacto complainant and others due to political enmity. The officer concerned has to get breathing time to investigate the case. Investigation is in the preliminary stage. Request for bail cannot be allowed at this stage.
The application is dismissed without prejudice to the petitioner moving again after the investigation has progressed.
