JUDGMENT / ORDER

The present application is filed by convict prisoner for extension of parole leave, which was granted by this Court vide order dated 11.04.2012 passed in Criminal Miscellaneous Application No.1022 of 2012, which was extended vide order dated 27.04.2012.
2. RULE.
Mr. H.K. Patel, learned Additional Public Prosecutor waives service of Rule on behalf of the respondent - State.
3. Learned APP made available the jail remarks. The very fact that the applicant convict is in jail for more than 13 years by now, be precise 13 years 8 months and 11 days as on 11.04.2012, does not require any in-depth inquiry into the matter. On perusal of the jail remarks, it is found that he has enjoyed eight times interim bail, nine times furlough leave and parole for six times and except on the occasion of return from the eighth furlough, he had reported late that too after the closing hours of jail and for that, he was given warning.
4. Learned advocate for the applicant submitted that the parole leave was sought for the construction of the house.
5. Taking into consideration the ensuing monsoon, the reason is reasonable. Parole leave granted to the applicant - convict by this Court vide order dated 11.04.2012 passed in Special Criminal Application No.1022 of 2012, which was extended vide order dated 27.04.2012 passed in Criminal Miscellaneous Application No.5785 of 2012 is further extended for a period of thirty days on the same terms and conditions. It is clarified that no further extension will be granted.
6. The applicant shall surrender before the Jail Authority immediately after the aforesaid period is over.
7. Rule is made absolute.
Direct service is permitted today.
