Heard learned counsel for petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"i). Command and direct the Sub Divisional Magistrate, Anoop Shahar, to hear and decide in case no 1/ 2019 Under Section Misc. Case "Ranjit Singh Vs. Uttam Singh" Mauza Kudhaini Pargana & Tehsil Debai, expeditiously, preferably with in stipulated period."
It appears that in proceedings under Section 122-B of the UP Zamindari Aboliltion & Land Reforms Act, benefit of sub-section (4-f) was provided to the opposite party.
Against this order, petitioner preferred a restoration application which was dismissed. However at the revisional stage, the matter has been remitted back to the Sub Divisional Magistrate, Anoop Shahar to re- decide the petitioner's restoration application which stated to be pending consequent to the order of remand dated 23.08.2018. Nothing further has been done and the restoration application of the petitioner is still pending consideration.
In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 1, Sub Divisional Magistrate, Anoopshahar to consider and decide the restoration application of the petitioner expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before the court concerned.
