The present application is by convict-prisoner forwarded through jail seeking temporary bail. The ground urged is that the applicant-convict wants to repair his house. In support of the cause, a certificate dated 21st January, 2012 from the Sarpanch and Talati of Gram Panchayat of Village Bhadarpura, Taluka-Thasra, District-Kheda is produced. The certificate dated 21st January, 2012 says that house is in bad condition.
Learned Additional Public Prosecutor Mr.L.R. Pujari invites attention of the Court to the jail record of the applicant. It inter alia mentions that on the same ground of house repairing, his application for temporary bail was rejected on 27th August, 2012. Juxtaposing the date in the certificate of Sarpanch/Talati produced in this application, which is dated 21st January, 2012, it is evident from the jail record that on the same ground, prayer for temporary bail has been rejected by this Court. What necessarily falls is that the present application is again sought to be moved by using the same ground on the basis of old certificate. Accordingly, the application is rejected. Notice is discharged.
