Sri Harish Chandra Mishra, Advocate has filed his vakalatnama on behalf of opposite party no.2, which is taken on record.
This criminal revision is directed against the judgment and order dated 13.2.2019 passed by the Principal Judge, Family Court, Jhansi in Case No. 1 of 2018, Smt. Rashmi Tandon and another versus Ranjeet Tandon, under Section 127 Cr.P.C. P.S. Nawabad, District Jhansi.
Heard learned counsel for the revisionist, learned AGA and learned counsel for opposite party no.2 and perused the record.
Learned counsel for the revisionist has tried to explain the circumstances of the revisionist in order to show that he is not a very well off person and is already leading a life of indigent circumstances. He has also tried to emphasis about the regular payment of maintenance amount as he was directed to pay by the court below. The only submission of the learned counsel for the revisionist is that the amount of maintenance is too excessive, hence reasonable reduction in the same may be made.
Learned counsel appearing on behalf of the opposite party no.2 has tried to stick to the need of the neglected wife and child.
It appears that though the impugned order does not suffer from any such express illegality or impropriety on the basis of which it may be said that the same deserves to be quashed or set aside but actually not much law is required in the matter and it is more or less a matter of equity of principle of natural justice and fair play. In the considered opinion of this Court, the order of the lower revisional court requires some modulation. Now it is being directed that the revisionist shall henceforth pay to the wife Rs.6,000/- per month as interim maintenance as was ordered by the court below while in place of Rs. 2,500/- per month to the minor daughter he shall now pay Rs.2,000/- per month to her.
With the aforesaid observations, the revision is disposed off.
