Heard Mr. Suresh Kumar Gupta, learned counsel for the petitioners and Mr. S.A. Murtaza, learned AGA for the respondents-State.
The writ petition seeks quashing of the First Information Report dated 20.04.2017 bearing Case Crime No. 0339 of 2017 under Sections 498A, 323, 504, 506, 354, 452, 307, 376, 377, 34 I.P.C. and 3/4 D.P. Act of Police Station Kalyanpur, District Kanpur Nagar. This Court vide order dated 08.05.2017 had directed not to take any coercive action against the petitioners, however, no order of stay of the investigation was granted. This order is operating since May 2017. We are informed that investigation is in progress.
In view thereof, by consent, we dispose of the petition with direction to the Investigating Officer not to take any coercive action against the petitioners during pendency of investigation and till submission of charge sheet/final report, without prior permission of the concerned court.
