The allegation against the applicant is that he has forged the signature of husband of opposite party no. 2 and has obtained electricity connection. He is sub-tenant of the property of the opposite party no. 2. It has further been submitted that the investigating officer has not made any effort to verify the fact whether the disputed signature belongs to the applicant or the deceased husband of the opposite party no. 2. It is submitted that on the basis of defective investigation the investigating officer has submitted charge sheet against the applicant.
This application is disposed of directing the court below to direct the investigating officer to investigate the fact whether the disputed signature have been made by the applicant or by the deceased husband of the applicant on the basis of the expert report and submit his supplementary report before the court below within the period of three months.
Till the submission of the supplementary report no coercive action shall be taken against the applicant in Case No. 6686 of 2018 (State vs. Ranjeet Sonkar) arising out of Case Crime No. 746 of 2017, under Sections- 419, 420, 467, 468, 471, 506, 120-
B I.P.C., Police Station- Civil Lines, District- Allahabad pending before the court of Chief Judicial Magistrate, Allahabad.
