Heard Sri Sudhakar Shukla, learned counsel for the petitioner, Sri Pawan Shukla, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to quash the FIR dated 3.4.2018, registered as Case Crime No.249 of 2018, under Sections 147, 148, 149, 307, 323, 341, 342, 436, 394, 332, 353, 186, 188 I.P.C. and 3/4 Public Property and Damage Act, 1984 and Section 7 Crl. Law Amendment Act, Police Station Kanpur Nagar, District Hapur.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. He further submits that the petitioner is a student of LL.B. IIIrd year and he is also doing the work under the supervision as Junior of Sri Sukhpal Singh and a certificate in this regard has also been issued on 23.4.2018, copy of which is annexed as Annexure-3 to the writ petition. The allegation levelled against the petitioner is absolutely false, frivolous and baseless. No offence is made out against the petitioner, hence, FIR is liable to be quashed.
Learned A.G.A. opposed the prayer for quashing of the FIR, but could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction, this petition is finally disposed of.
