Petitioner was employed as Executive Officer in various local bodies from time to time and has ultimately superannuated on 30th September, 2012. Grievance is that though he has been given all retiral benefits, but benefit of ACP, which was due and payable to him, has not been extended so far. It is stated that on account of it, the correct determination of pension etc. has not taken place. Submission is that various representations in that regard made from time to time, have not been examined so far. Reliance is placed upon a direction issued by the Director, Local Bodies, dated 15th December, 2018, granting benefit of ACP to the Executive Officers.
Learned Standing Counsel states that the petitioner's grievance would be examined by the competent authority, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.2, in respect of his grievance annexing all relevant materials in support of his claim, alongwith certified copy of this order, within two weeks from today. The Director concerned shall examine petitioner's grievance and shall pass suitable orders, as may be warranted in law, in light of the facts, noticed above, within a period of three months, thereafter.
