Unfortunately even in the third round, counsel was not present as may be the Board was belatedly prepared. According to him he had kept the petitioners present.
Sri Ranjeet Kumar, petitioner no. 1 facing investigation by way of Case Crime no.355 of 2020 for the offence under Sections 363 and 366 IPC, Police Station Karhal, District Mainpuri.
Petitioner no. 2 states that she is major. It is further stated by the petitioner no. 2 that she has willingly married with petitioner no.1.
The investigation is still going on and the charge sheet has yet not been laid. We are unaware of the factual scenario as of today in the matter.
With all the documents, if the petitioner no. 1 move the Court below for being enlarged on bail as it appears that petitioner no.1 has entered into wedlock with petitioner no.2. If the complaint is heard by us, and it would take long time, we relegate the petitioner no.1 to the Court below to apply for anticipatory / regular bail which shall be decided within four weeks from the date of its filing. We are not opining anything further on merits. All these aspects, the Court shall consider and decide the bail application of the petitioner no.1. The Police Authorities shall not coercively deal with the petitioner no.1.
With aforesaid observations, this petition is disposed of.
