Heard Sri Prashant Shukla, learned counsel for the petitioner, learned Standing Counsel for the respondent No.1-State and Sri Rohit Pandey, learned counsel for the respondent Nos.2 and 3.
The only prayer made by Sri Prashant Shukla, learned counsel for the petitioner is that the punishment imposed by the respondent-University is too harsh and disproportionate to the offence committed by the petitioner. He submits that the petitioner is young and because of lack of maturity may have committed some indiscretion. The petitioner is entitled to a second chance in life to reform himself and be re-integrated in the society as responsible citizen. He submits that the petitioner would like to make a second representation to the respondent- University highlighting the mitigating circumstances of his case.
Sri Rohit Pandey, learned counsel for the respondent-University does not have any serious objection to the aforesaid prayer.
The writ petition is disposed of permitting the petitioner to make a representation to the respondent-University in regard to the punishment of being debarred for two academic years for the act of using unfair means. In case such representation is submitted within a period of two weeks, the same shall be decided by the respondent-University within a period of one month from the date of receipt of a certified copy of this order along with the representation.
