JUDGMENT / ORDER

Heard Mr. Pujara, learned advocate for the petitioner, and Mr. Ashar, learned AGP, for the respondent - State.
Having considered the details mentioned in the petition and contentions raised by the learned counsel for the petitioner, it emerges that the petition requires consideration.
Hence, Rule.
Rule be made returnable on 29.6.2012.
By way of interim relief, the respondents are directed to pass order within period of 3 weeks from today, with regard to the request made by the petitioner in present petition, after taking into account the decisions by the Court in case of Solanki Bharatkumar Khushalbhai v. District Primaryu Edution Officer [2002 (2) GCD 1062], Patel Naynaben Revabhai v. State of Gujarat [2003 (0) GLHEL 209303] (i.e. the decision dated 27.2.2003 in Special Civil Application No.4603 of 2000) as well as the decision dated 24.2.2010 in Special Civil Application No.5287 of 2009.
The competent authority shall pass appropriate reasoned order within above mentioned time limit and after taking into account the aforesaid decisions.
The order so passed by the competent authority shall be conveyed to the petitioner, who will be at liberty to place the same on record of present petition.
Direct service is permitted.
