JUDGMENT / ORDER

1. Rule.
Mr. Nirzar Desai, learned Counsel appearing for both the respondents waive notice of rule on behalf of the respondents. Considering the averments made in the application and with consent of the learned Counsels appearing for the parties, the application is taken up for final hearing forthwith.
2. It appears from Annexure 'A' - Death Certificate that the original respondent of Special Civil Application No.1289 of 2010 Shri Dashrath Ramanbhai Sikligar has expired on 9.10.2011. By the present application, the legal heirs i.e. wife and three sons have prayed for being joined as party respondents in the main petition.
3. Considering the averments made in the application and on the consent expressed by Mr. Desai, learned Counsel appearing for the opponents - original petitioners, the application deserves to be accepted and the same is allowed. Rule made absolute with no order as to costs. Registry is directed to list the main matter for final hearing in the week beginning from 01.05.2012.
