Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to direct the court below to decide the proceedings of Misc. Case No. 132 of 2014 (Smt. Ranjana Singh @ Pinku Vs. Rajeshwar Singh Bhadauriya and others), arising out of Case No. 90 of 2012 (Smt. Ranjana Singh @ Pinku Vs. Rajeshwar Singh Bhadauriya and others), under Section 25(2) Protection of Women from Domestic Violence Act, 2015 within the period of one month.
Learned counsel for the applicant submits that an application dated 3.5.2017 was moved by the applicant before the Additional Chief Judicial Magistrate, Court No. 10, Fatehpur alleging that the court below had directed the opposite party no. 2 to pay maintenance allowance of Rs. 5,500/- to the applicant in which Rs. 2000/- to the applicant, Rs. 1000/- and Rs. 1000/- to the two daughters and Rs.1,500/- for rent in case of not providing an accommodation, shall be paid. It is further submitted that the opposite party no. 2 has not given the money to the applicant, therefore, she is suffering great hardship. It was lastly prayed in the aforesaid application that the court may be pleased to pass an order for providing an accommodation to her.
Considering the fact that the trial has remained pending since the year 2014. Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, within a period of two months from the date of production of certified copy of this order, without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
