This is an application for bail on behalf of accused applicant Ranjan Singh @ Anand Singh, who is detained in Crime No.15/2010 under Sections 302, 404, 411 I.P.C., Police Station Kotwali Kadipur, District Sultanpur.
Heard the learned counsel for the applicant and the learned A.G.A for the State.
It is argued on behalf of the applicant regarding the genuineness of the prosecution case that the applicant has been falsely involved in the case ; that there is no eye witness account of the incident wherein murder of Daleep Singh took place. That the applicant Ranjan Singh alongwith Aftab and Sukhdev have been roped in this case by the police on the basis of the alleged confession made by Aftab and Ranjan Singh which is not admissible in evidence. That the co-accused Aftab Alam and Sukhdev Harijan have been admitted to bail by this Court by Hon'ble R.M.Chauhan,J in Crl. Misc. Case No.3909 (B) of 2010 and Crl. Misc. Case No.4060 (B) of 2010 under his orders dated 17.5.2010 and 21.5.2010, respectively and as such the applicant should be enlarged on bail.
The bail is opposed by the learned A.G.A.
I have considered the respective submissions made by the parties. The nature of accusation, severity of punishment in case of conviction, the nature of supporting evidence, possibility of threat to the witnesses by the applicant, genuineness of the prosecution case and broad spectrum of the proposed evidence have also been duly considered. Roving inquiry into the pros and cons of the material is not necessary. In view of the facts and circumstances of the case that similarly situated co accused have also been admitted to bail, I am of the opinion that it is a fit case for granting bail.
Let the applicant be released on bail on his furnishing a personal bond with two reliable sureties each to the satisfaction of the Chief Judicial Magistrate concerned.
