JUDGMENT / ORDER

----------------------- The petitioner has obtained Passport from Karnataka. In the Passport petitioner’s place of birth was shown as Ujire, Karnataka. The petitioner submits that her actual place of birth is Arunapuram, Kottayam, Kerala. The petitioner relies on Ext.P1 birth Certificate. The petitioner has approached the respondent for correcting the details in the Passport. The Passport Authorities refused to consider the application of the petitioner as the petitioner have obtained the Passport from another State, and submitted that it may not be possible to correct the place of birth if the place of birth shown in the Passport is of different State. Accordingly the petitioner has approached this court.
2. A statement has been filed on behalf of the respondent.
It is stated that the original Passport held by the petitioner was issued in continuation of Passport No.K 3225518 issued on 14.6.2012 by Regional Passport Office, Bangalore, in which the place of birth W.P.(C).No.29600 of 2014

entered is ‘Ujire – Karnataka’. The entries in her old Passport were carried over to the new Pasport on reissue. The petitioner had submitted her 10th Standard certificate while applying for the Passport and based on the above certificate, the Passport was issued. It is further stated in the counter affidavit that under Chapter 8, paragraph 6 of the Passport Manual 2010 “when such change is sought to be made from one state to another, or from India to abroad or vice versa, the case should examined thoroughly and properly contested in court”. Necessarily the Passport Issuing Authorities insist for thorough probe for correction of date of birth in order to find out the bonafides of the claim. The petitioner relies on Ext.P1 the birth certificate issued by the local authority. Therefore, if the petitioner produce the orginal or certified copy of Ext.P1, and on being satisfied with the above, the Passport Authority shall entertain the request of the petitioner to correct W.P.(C).No.29600 of 2014

the place of birth in the Passport. Needful shall be done based on the above directions within a period of two weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
