Present revision has been filed challenging the judgement and order dated 7.7.2001 passed by the Judge, Family Court, Moradabad in Case No. 140/11/99 (Smt. Rani and another vs. Mohd. Intezar), whereby the application filed by the revisionist under Section 125 Cr.P.C. has been rejected.
On perusal of record I find that the grounds taken in the revision are that the court below has not considered the evidence on record and has not considered the implication of Criminal Case No. 472 of 1999, under Section 498A IPC and Section 3/4 of D.P. Act, which was a sufficient cause of living away from the opposite party.
The finding has been recorded that the revisionist is living separately on her own will.
I do not find any legal infirmity or jurisdictional error in the order impugned herein.
Interim order, if any, stands vacated.
Present revision is devoid of merits and is accordingly dismissed.
