JUDGMENT / ORDER

Rule.
Mr.K.P. Raval, learned Additional Public Prosecutor, waives service of notice of Rule on behalf of respondent-State.
By way of present application, filed under Section 389 of the Code of Criminal Procedure, the applicants have prayed to release them on bail pending the Criminal Appeal.
The learned 2nd Additional Sessions Judge, Nadiad tried the applicants for the offence punishable under Sections 147, 148, 149, 427, 504 of the Indian Penal Code and under Section 3(1)(X) of the Scheduled Casts and Scheduled Tribes (Prevention of Atrocities) Act and convicted the applicants.
Heard Mr.Raxit Dholakia, learned counsel for the applicants and Mr.K.P. Raval, learned Additional Public Prosecutor for the respondent-State.
Mr.Dholakia, learned counsel for the applicants, states that the applicants were on bail pending the trial and today also the applicants are on bail. He has produced copy of order dated 21st April, 2012 passed by the learned Judge, which is taken on record.
Looking to the facts of the case, I am of the opinion that this is a fit case to allow. Hence, the present application is hereby allowed. The applicants-original accused are hereby ordered to be released on bail on their furnishing a personal bond of Rs.05,000/- (Five Thousand Only) each and on usual terms and conditions. Rule is made absolute to the aforesaid extent.
Direct Service is permitted.
