JUDGMENT / ORDER

. Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to grant anticipatory bail to the petitioners/ accused No. 2,3 and 5 in Crime. No. 54 of 2014 on the file of P.S.I Town, Khammam District.
The petition coming on for hearing, upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI K. L. B. KUMAR, Advocate for the Petitioners, and of the Public Prosecutor, for the Respondent, the Court made the following ORDER Petitioners are A2, A3 and A5. They seek for grant of anticipatory bail. They allegedly committed offences under Section 420 IPC. The offences are triable by a Magistrate of First Class. Therefore, it would be appropriate for the petitioners to surrender before the trial Court and move the trial Court for grant of regular bail.
However, the first petitioner, who is A2 is a lady. In view of the sex of the first petitioner, I consider it appropriate to enlarge the first petitioner on anticipatory bail.
Consequently, this Criminal Petition is allowed so far as the first petitioner is concerned. The first petitioner shall surrender before the learned First Additional Judicial Magistrate of First Class, Khammam, within two weeks from today. On such surrender, the learned First Additional Judicial Magistrate of First Class, Khammam, shall enlarge the first petitioner on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to his satisfaction.
This Criminal Petition is disposed of so far as the petitioners 2 and 3 are concerned giving liberty to the petitioners 2 and 3 to surrender before the trial Court and move the trial Court for grant of regular bail. In such an event, the Trial Court shall consider such an application on merits, without being influenced by any part of this order, and shall dispose of the same on the same day on which it is filed.
