Chavan Naika, Advocate for R1 & R2) These Writ Petitions are filed under Article 227 of the Constitution of India praying to quash the order passed by the learned Senior Civil Judge and JMFC at Kadur in O.S.No.26/2013 on I.A.No.2 dtd.22.3.2014 vide Annex-K and the judgment and order passed by the learned I Additional District Court, Chikmagalur in MA.No.1/2014 dtd.16.3.2015 vide Annex-M in so far as it relates to Item No.3 of the suit schedule properties and etc.
These Writ Petitions coming on for Preliminary Hearing, this day, the Court made the following:
O R D E R 2nd defendant in O.S.No.26/2013 on the file of the Senior Civil Judge and JMFC., Kadur, who was appellant in M.A.No.1/2014 on the file I Additional District and Sessions Judge, Chickamagalur has come up in these Writ Petitions impugning the order dated 22.03.2014 passed on I.A.No.2 which was confirmed by the Appellant Court by order dated 16.03.2015.
2. When this matter is taken up for consideration this day, the stage of the proceedings in O.S.No.26/2013 is looked into in the e-courts website of Chikmagalur District. On going through the same, it is seen that O.S.No.26/2013 has already been disposed of on merits by judgment dated 01.08.2018. Therefore, nothing survives for consideration in these Writ Petitions as the same have become infructuous. Accordingly, these Writ Petitions are dismissed as having become infructuous.
