JUDGMENT / ORDER

Rule. Mr. Rashesh Rindani, learned AGP waives service of notice of rule for respondent No.1 State. 1. This grouped petitions have been filed essentially seeking implementation in spirit & letter of the order passed by this Court in group of petitions being Special Civil Application No. 12266 of 2011 with cognate matters decided on 31/8/2012 (Coram: Anant S.Dave, J), as despite their being no other order obtained from any forum permitting the State to avoid implementation, these petitions were required to be filed.
2. Learned advocates have jointly requested for clubbing of the matters together and to be decided finally as the entire controversy is in a very narrow compass.
3. The reply affidavits have been filed in these petitions, wherein the averments made on oath by the petitioners qua they being exactly similarly situated qua the petitioners in whose favour the orders are inuring or atleast they are interested in the reshuffling that is to be required to be carried out on account of the order passed by this Court in Special Civil Application No. 12266 of 2011 and cognate matters. The one and the only contention raised in the affidavit in reply is that the State is contemplating to prefer Letters Patent Appeal challenging the order which is sought to be relied upon by the petitioners for seeking appropriate prayer in these petitions.

This Court is therefore of the view that, without elaborately dwelling upon the fine contentions that may arise, which in fact have not been even impeded by the parties, suffice it to say that in light of the averments made by the deponent of the affidavit in reply, it is very clear that the stand of the petitioners qua they being aggrieved on account of non- implementation of the directions issued by the Court seems to be uncontroverted, and hence all these petitions are disposed of by a direction that the petitioners shall also be governed by the directions that have been issued by this Court in Special Civil Application No. 12266 of 2011 with cognate matters decided on 31/8/2012. With this directions petitions are allowed in above terms. Rule made absolute in each petition. However, there shall be no order as to costs.
5. Registry to maintain copy of this Judgment & order in each of the petitions.
